How Ontario Law Treats Islamic Marriage and Divorce

Is my nikah legally valid in Ontario?

A nikah performed in Ontario is legally valid if it meets Ontario’s marriage requirements, including a marriage licence or banns and a person authorized to perform marriages. A nikah performed abroad is usually recognized if it was valid where it took place. If you had a religious ceremony only, without registration, your legal rights may be very different. Does a talaq or khula end my marriage in Canada?

A religious divorce, such as a talaq or khula, does not by itself end a marriage under Canadian law. To be legally free to remarry in Ontario, you generally need a divorce from a Canadian court, or a foreign divorce that Canadian law recognizes. A divorce granted outside Canada may or may not be recognized here, depending on where it was granted and the connection the spouses had to that country. Read more: Religious divorce in Canada.

Can a spouse refuse a religious divorce?

Under the federal Divorce Act, a court can take steps where one spouse refuses to remove a barrier to the other spouse’s religious remarriage. This can be important in some faith communities, and it should be raised early in your case.

Can Sharia law be used to decide my case in Ontario?

No. Ontario family arbitration must be conducted under Ontario and Canadian law, and arbitration based on religious law is not enforceable as a family arbitration. Parties may still follow religious guidance privately, but the court applies Ontario law to property, support, and parenting. Read more: Sharia law and family law in Ontario.

Mahr and Property Division

A mahr is the gift or payment promised to the wife at the time of the nikah. Ontario courts have, in some cases, enforced a mahr as a marriage contract under the Family Law Act, depending on how it was written, whether it was signed properly, and the circumstances of the marriage. In other cases, courts have refused to enforce it. Whether a mahr is enforceable, and how it interacts with the equalization of net family property, depends on the details.

Property outside Canada, such as a house or land in Pakistan or India, is generally included when calculating net family property in Ontario. Valuing and dividing foreign assets can be complicated, and we help gather the right documents.

Sponsorship and Immigration Concerns

If you sponsored your spouse to come to Canada, your financial undertaking to the Government of Canada usually continues even after you separate. Separation may also raise questions for a sponsored spouse. Family law and immigration law can overlap, and we explain how your family law case may affect your situation. Frequently Asked Questions

Do you speak Urdu, Punjabi, and Hindi?

Yes. Nasar Iqbal serves clients in English, Urdu, Punjabi, and Hindi, so you can explain your situation in your own words.

Is my mahr enforceable in Ontario?

It depends. Ontario courts have enforced some mahr agreements as marriage contracts and refused others. The wording, signatures, and circumstances matter, so bring your nikah nama to your consultation.

I received a talaq overseas. Am I divorced in Canada?

Not necessarily. Whether a foreign divorce is recognized in Canada depends on where and how it was granted and the spouses’ connection to that country. A lawyer can review your documents and tell you whether you need a divorce in Ontario.

Will my case stay confidential?

Yes. Communications with your lawyer are protected by solicitor-client privilege. We understand that privacy within the family and community is important.

Where are you located?

Our main office is at 55 Village Centre Place, Suite 200, Mississauga, and we also have an office at 277 Lakeshore Road East, Suite 408, Oakville. Virtual meetings are available.
