The matrimonial homeA divorce is uncontested when nobody is disputing the divorce itself or the issues around it. Either you and your spouse agree on everything, often in a signed separation agreement, or your spouse is served and does not respond. These divorces are usually decided on paper, without anyone going to court.
You can apply jointly with your spouse, or one of you can apply alone (a simple divorce). Either way, the court needs to see that you qualify, that the paperwork is complete and that proper child support arrangements are in place if you have children. Most delays in uncontested files come from small errors: a wrong date of separation, a missing marriage certificate translation, or child support information the court does not accept.

A divorce is contested when you and your spouse cannot agree on parenting, support or property, or when one of you disputes the divorce claim. In Peel Region these cases are heard by the Superior Court of Justice in Brampton, and usually move through these stages:
A contested divorce does not have to mean a courtroom battle. Many of our cases settle through negotiation or mediation once both sides have full disclosure and realistic advice. Where the other side will not engage, we prepare your case properly for court.
To get a divorce in Ontario, you or your spouse must have lived in Ontario for at least a year, and your marriage must have broken down. Almost everyone proves this by living separate and apart for one year. You can be separated under the same roof if the marriage has ended in substance.

The one-year separation is the minimum. After filing, an uncontested divorce commonly takes several months, depending on service, how quickly both of you sign and the court's workload, plus 31 days before the divorce takes effect. Contested divorces often take a year or more. We will give you an estimate based on your facts, not a generic number.
There are two parts. Court fees for a divorce were about $669 at the time of writing. Legal fees depend on how much work your file needs: a joint application with no children and no property issues is at one end; a contested case with parenting, support and property disputes is at the other. No. After one year of separation you can apply on your own. If your spouse is served and does not respond, the court can still grant the divorce.
It is not legally required, but a lawyer can make sure the paperwork is right and that you are not giving up support or property rights without realizing it. Limited-scope help is available.
Generally yes, if the marriage was valid where it took place and you or your spouse has lived in Ontario for at least a year. You will need the marriage certificate and a certified translation if it is not in English or French.
No. A religious divorce such as talaq or khula does not end a marriage under Ontario law. You need a civil divorce from the Superior Court to remarry legally in Canada.
Both married spouses have an equal right to live in the matrimonial home until an agreement or court order says otherwise. Its value is shared through equalization of net family property. Buying out, selling or a delayed sale are the usual options.
Thirty-one days after the judge grants the divorce order. You can then request a Certificate of Divorce, which you need to remarry.

I recently employed Nasar to represent me on a mediation/arbitration matter. After having so many lawyers over the years who struggled to manage my case and build a respectful and non contentious relationship with opposing counsel, I entered my engagement with some trepidation.The issues were of considerable complexity and required a substantial understanding of Family Law and corporate law.
