Hamilton's Unified Family Court

Hamilton is one of the places in Ontario with a Unified Family Court, at 55 Main Street West, Hamilton. It is a branch of the Superior Court of Justice that deals with every type of family case in one place: divorce, parenting, child and spousal support, property and child protection. You do not have to choose between two courts, as families in some other cities do.

Many families settle without a judge deciding anything, through negotiation, mediation or a separation agreement. When a court case is needed, it usually moves through these stages:

  1. Application and serviceThe application sets out what you are asking for and is served on the other party, who then has a set time to respond.
  2. Mandatory Information ProgramA free session on the court process and options such as mediation, required in most cases.
  3. Financial disclosureSworn financial statements and supporting documents for income, assets and debts.
  4. Case conferenceAn informal meeting with a judge to narrow the issues, check disclosure and encourage settlement.
  5. Motions, settlement conference and trialTemporary orders if something cannot wait, a further push to settle, and a trial only for what is left.

Getting divorced in Hamilton

To divorce in Ontario, you or your spouse must have lived in Ontario for at least a year, and you must usually have been separated for one year. You can be separated under the same roof if the marriage has ended in substance. If nothing is disputed, a judge can grant the divorce on paper, and it takes effect 31 days later.

Court fees for a divorce were about $669 at the time of writing. A divorce ends the marriage, but it does not by itself settle parenting, support or property, so most people deal with those in a separation agreement first. See our guide to the divorce process in Ontario.

The house, pensions and property

If you are married, both spouses have an equal right to live in the matrimonial home, whoever is on title, until an agreement or court order says otherwise. Neither spouse can sell or mortgage it without the other's consent or a court order. Its value is shared through equalization of net family property, and a matrimonial home owned before the marriage is generally not deducted the way other pre-marriage assets are.

Many Hamilton workers have a workplace pension, often a defined benefit plan. The part earned during the marriage is family property. The plan administrator provides a family law value, and equalization can sometimes be paid by transferring part of the pension rather than in cash. Each option has tax and cash-flow effects, so get advice before you agree.

Children, parenting time and support

Ontario law now uses "decision-making responsibility" and "parenting time" instead of custody and access. Every decision is based on the child's best interests. If one parent wants to move with the children, for example from Hamilton to the GTA, the relocation rules require written notice in advance, and the other parent can object. Child support is calculated under the Child Support Guidelines, mainly from the paying parent's income and the parenting schedule. If each parent has the children at least 40% of the time, the calculation changes; see the 40% rule.
