⚖️

Uncontested vs. Contested Divorce

An uncontested divorce is one where both spouses agree, or at least do not dispute, the end of the marriage and the main issues: parenting, support and property. These are usually quicker and cost less. See our guide to a simple divorce in Ontario for how this works.

A contested divorce means there are issues in dispute, such as where the children will live, how much support is payable, or how property is divided. These may involve negotiation, mediation and, if needed, court applications. Many contested cases still settle before trial.

🏛️

Court Information for Brampton and Peel Region

Family cases for Brampton residents are heard at the Brampton courthouse, 7755 Hurontario Street. A divorce itself can only be granted by the Superior Court of Justice. The Ontario Court of Justice in Brampton hears some family matters, such as parenting and support, but cannot grant a divorce. Which court is right depends on what you are asking for, and we can explain that at your consultation.

📋

Who Can File for Divorce in Ontario

Under the federal Divorce Act, at least one spouse must have lived in Ontario for at least one year before the application is filed. The most common ground is that the marriage has broken down because the spouses have lived separate and apart for at least one year. Spouses can be separated while still living in the same home if they live separate lives.

⭐

Joint vs. Sole Application

If both spouses agree to divorce, they can apply together in a joint application. This avoids formally serving one spouse and can make the process simpler. If your spouse will not cooperate, or you do not know where they are, one spouse can file a sole application and serve the other. We can advise which route suits your situation, including what to do if your spouse cannot be located or does not respond.

📝

The Divorce Process: Step by Step

  1. Consultation: we review your situation, documents and goals.
  2. Gather information: marriage certificate, financial disclosure, details about the children.
  3. Agreement or application: where possible, we negotiate a separation agreement. Otherwise we prepare and file an application.
  4. Service: the other spouse is formally served, unless it is a joint application.
  5. Resolve the issues: negotiation, mediation or court steps for any disputed matters.
  6. Divorce order: once the court grants the divorce, it takes effect after the appeal period, and you can then request a divorce certificate.
📍

Divorce Paperwork in Ontario

A divorce application is filed with forms prescribed by the Family Law Rules. In an uncontested case the court generally reviews the written documents, including a sworn affidavit, without a trial. Errors or missing information are the most common reason files are sent back, which delays the divorce. If your marriage took place outside Canada, you may need to prove the marriage and translate the certificate, and we can tell you what the court will accept.

⏱️

How Long Does a Divorce Take?

An uncontested divorce can often be completed within several months once the paperwork is filed correctly. Contested cases take longer. Timing depends on the court schedule, how quickly financial information is exchanged and whether the issues can be settled.

💰

Divorce Costs in Brampton

ServiceFee
Initial consultation (up to 30 minutes)$150
Uncontested divorce$1,500 plus HST, plus disbursements (about $900, mainly court fees and service)
Contested matters$350 per hour plus HST

Full details are on our legal fees page, and our family lawyer cost guide explains what drives the cost of a family case.

📝

What Affects the Cost of a Contested Divorce

The main drivers of cost in a contested case are the number of issues in dispute, how much financial disclosure is needed, whether experts are required, how many court events take place and how willing each side is to compromise. Negotiating early, exchanging disclosure promptly and using mediation can reduce cost. In some matters we can discuss limited-scope help, where we take on specific tasks rather than the whole file. The details are set at your consultation.

👪

Child Custody, Parenting Time and Child Support

Under the Divorce Act and Ontario's Children's Law Reform Act, courts decide parenting issues based on the best interests of the child. The law now speaks of "decision-making responsibility" and "parenting time" rather than custody and access. Child support is generally set by the support guidelines using the paying parent's income and the number of children. You can get an estimate with our child support calculator.

❓

Decision-Making and Parenting Plans

Parents are encouraged to agree on a parenting plan covering where the children live, how holidays and school breaks are shared, how major decisions about health, education, culture and religion are made, and how parents will communicate. Courts focus on the child's physical, emotional and psychological safety and well-being, the child's relationship with each parent, and each parent's willingness to support the child's relationship with the other. A clear written plan reduces future disputes and is easier to enforce if problems arise.

Relocation also matters for Brampton families. A parent who wants to move a significant distance with the children generally has to give notice and, if there is no agreement, may need the court's permission. If you are thinking about a move, speak to a lawyer first.

⚖️

Child Support in More Detail

Guideline child support is based on the paying parent's gross income and the number of children. When parenting time is shared and each parent has the children at least 40% of the time, the calculation looks at both incomes and the added costs of the arrangement. Child support is separate from Section 7 expenses, such as child care, uninsured medical and dental costs, and post-secondary education, which are usually shared in proportion to income.

Child support does not automatically end when a child turns 18. It can continue while the child is a dependant, for example in full-time studies. A change in income or parenting time may justify a change to support, but this needs a formal agreement or court order. Parents who are owed support can enrol the order with Ontario's Family Responsibility Office for enforcement.

🏠

Property Division

Under Ontario's Family Law Act, married spouses generally share the growth in value of property built up during the marriage through an equalization payment. The matrimonial home has special rules, and certain assets such as gifts and inheritances may be excluded. Property rights differ for unmarried couples, so it is important to get advice early.

📋

The Family Home, Pensions and Debts

Both married spouses have an equal right to possession of the matrimonial home while living together, regardless of whose name is on title. When separated, one spouse may stay in the home by agreement or court order, or the home can be sold or one spouse can buy out the other. Pensions, business interests, RRSPs and debts all go into the equalization calculation, and valuing them often requires an accountant or pension valuator. Because each spouse calculates their net family property as of the date of separation, accurate dates and documents matter.

There are time limits for property claims. In general, a property claim must be started within six years of separation or two years of the divorce, whichever comes first. If you are close to a deadline, get advice promptly.

🤝

Spousal Support

Spousal support depends on factors such as the length of the relationship, each spouse's income and needs, and roles during the marriage. The Spousal Support Advisory Guidelines are often used to estimate ranges, but they are not binding.

A spouse may be entitled to support based on need, ability to pay and the effects of the relationship, such as time out of the workforce to raise children. Support can be time-limited or open-ended, and the guidelines give ranges for amount and duration. Longer marriages and larger income gaps generally point to higher or longer support, but each case turns on its own facts. Spousal support can usually be reviewed if circumstances change significantly.

🛡️

Separation Agreements and Mediation

Many families resolve their issues without a trial. A separation agreement can set out parenting time, support, the matrimonial home and the division of property, and it can be enforced if it is properly signed and both spouses have made full financial disclosure. Family mediation is a way to reach agreement with the help of a neutral person, and it is often faster and less costly than going to court. Each spouse should still get independent legal advice before signing.

⚠️

If Safety Is a Concern

If you or your children are at risk, your safety comes first. In an emergency, call 911. Courts can make urgent orders about parenting, exclusive possession of the home and protection from harassment or violence. Tell us about safety concerns early so we can plan accordingly, and let us know if you need information delivered in a way that keeps you safe.

💬

What to Bring to Your Consultation

  • Marriage certificate and date of separation
  • Names and birth dates of the children and a summary of current parenting arrangements
  • Recent income tax returns and Notices of Assessment for both spouses, if available
  • Information about your home, bank accounts, pensions, debts and business interests
  • Any existing court orders or agreements

You do not need everything on day one. We can start with what you have and tell you what else will be needed.

👪

What Happens at Your First Consultation

The $150 consultation (up to 30 minutes) is a focused meeting to understand your situation. We ask about your marriage, separation date, children, income and property, and then explain which court applies, the realistic options, the likely steps and the expected costs. You will leave with a clear picture of what to do next, whether or not you decide to hire us. If you do, we confirm the scope of work and fees in writing. You can meet us by phone or video if travelling from Brampton is inconvenient.

Many people wait because they are unsure what to expect. Getting accurate information early often saves time and money, and it helps you avoid decisions that are hard to undo.

⚠️

Common Mistakes to Avoid

  • Signing before getting advice: an agreement signed without understanding it can be hard to change.
  • Hiding or underreporting income or assets: full financial disclosure is required and agreements can be set aside if disclosure was incomplete.
  • Stopping support payments on your own: only a formal change can adjust support; arrears do not disappear.
  • Using the children as messengers: courts focus on the children's best interests, and conflict affects them.
  • Waiting too long: some property and support issues have time limits, so get advice early.
🌍

After the Divorce

A divorce changes more than your marital status. You may need to update your will and beneficiary designations, review powers of attorney, and deal with the transfer of the matrimonial home. If you wish to change your name back, you can do so after the divorce. We can help you with these next steps as well, and our fees page lists current prices for wills and related services.
